Procedure for Appointment of Judges

Each High Court will have a Chief Justice and some other judges whose number is decide by the President (Article 216)

  • The Chief Justice of the High Court shall be appointed by the President of India in consultation with the Chief Justice of India (S C) and the Governor of that State and in the appointment of other judges, the Chief Justice of the concerned State shall also be consulted (Article 217 (1)
  •  The Collegium System for appointment of judges o the Supreme Court and High Courts has been replaced by a new body, the National Judicial Appointments Commission, by the 99th Constitution Amendment Act 2014 and the National Judicial Appointments Commission Act 2014 Although in 2015 by the Supreme Court both the amendment and the NJAC Act have been declared unconstitutional As a result, the old Collegium system is n existence again This decision was given by the Supreme Court in Fourth Judges Case (2015).
